Item is not as described - help with what to do next.

I recently bought a second hand baby gym which the seller described as being in "perfect condition."  When I received it the gym was missing all its 5 detatchable toys, but worse that that the main arch that held it up was held together with cellotape.  In my view the gym is dangerous because the parts that are cellotaped is holding the heaviest parts of the toy and it could easily come apart and fall on my baby.  It also houses the electrical wiring so again very dangerous.

 

I emailed the seller to with photos showing these things.  They replyed to say that the toy was perfect when they sent it to me but as I have obviously changed my mind they were happy for me to return it.  From reading this response I assume that when I send it back to them they will say I damaged the toy and kept the missing toys and refuse to refund me the money.  I went back and reexamined their listing and they have only shown photos of the gym inside the packaging so you can not see that it is broken.

 

With hindsight I should never have bought the item based on the images shown, but I have been buying second hand items on ebay for years and years and noone has done this to me before.  So now I don't know what to do.  I don't want the hassle of sending it back to them and not getting a refund and I also don't want to give it back tto them and they relist the item and play this trick on someone else.  I was expecting to go the Resolution Centre and open a dispute so I could get Ebay involved, but this system doesn't seem to exist.  So what can I do to make sure I get reimbursed?

The resolution centre is at the bottom of the page or if you click on Seller help items you bought should come up and you can open from there.

You have to return items but is you choose the correct dispute of now as described then the seller should send a pre paid label for the return

Open a not as described dispute at the bottom of the page under Resolution Centre.

Escalate it after a full 3 days of opening the dispute.

The seller needs to send a pre paid label for the return.

If they dont then ebay should when you escalate the dispute.

Make sure it goes back tracked and that the tracking is in the dispute.

You have 30 days from the day of delivery to open a dispute in ebay
