Item description does not match item but seller does not want to pay me return postage.

Item says it was Uk12, arrived as Uk8 and seller does not want to give me a refund for postage? Seller advises Rbays return policy is such that they are in the right but it was a pointless purchase as item marked as one size but received as another. Pretty sure my legal rights have been wavered illegally by seller?

You can start a "not as described" return via More Actions on the far right of your order in Purchase History.  Then escalate it after 3 business days.  As long as the seller is in the UK ebay will require them to issue a paid-for postage label for you to print and use.  And they will enforce the refund after return.
