Item described as used, arrived and it's really poor condition, can I return it?

Bought a red toy pull cart for my child, small simple description, "used toy cart"

Arrived in good time, I paid half rrp, it looks terrible, pait completly faded, rust, wheels not level, scratched badly, now when I look at the listing the phontos were taken from a distance, no close up.

So obvioulsy the seller didn't tell any lies,  I've just come to expect most buyers will point out issues if an item has any, if an item has no issues they just keep the description short an simple.

Seller won't respond to my messages to address my concerns, don't want to open a case unless I think ebay see it as a resonable thing to do.

Hands up, I rushed this purchase and messed up but I feel the seller has been a little sneeky

Have you never read the Money Back Guarantee TOP RIGHT of every listing.  It should not be necessarybto ask this sort of question.

You open a Not As Described Case and seller has to provide a Reply Paid Label and on return make a full refund.

Seller should give all faults in CONDITION, that is what it is for. If they don't then the item is not described correctly.

If they fail to deal with the case when opened, after 3 days you can escalate to ebay to take over.
