How can people keep getting away with writing BNWT and selecting new without tags in the item specs?

How come eBay doesn't clamp down on people writing BNWT (with tags) in the title and description of an item but then if you dig deep they choose new without tags on the long list of item descriptions? I think this is sneaky and for any other selling site would be false advertising. I've recently asked one seller to clarify if it had tags and they confirmed despite listing it as BNWT that it didn't but they didn't care as they didn't see a problem. Can we just write anything in the description so long as the drop down menus in the other parts are correct???

There will always a be small minority of dubious sellers,which is why all buyers should always read the listing description and get clarity before committing to buy if needs be.
