GSP shipping , lost item

I sold an item 24th January, from UK to French buyer, used the correct procedure , booked Hermes through packlink to send to Lichfield  GSP centre , item was then sent to France and shown as out for delivery to customer 5th February. 8 days later the buyer messaged to say item was not received, i contacted ebay through the chat system and was told not to worry GSP will refund the customer, he emailed a couple of days later to say ebay France says he has no buyer protection and he cant claim. Strangely the item was suddenly marked as delivered.....He then made a claim through paypal , but it was refused as i added the tracking details to show i had sent it , to cut a long story short i have had about 25 messages from the buyer, contacted ebay 5 times and paypal 4 times and no one will refund the poor guy , im thinking i may just have to send him a refund through goodwill, has anyone else been failed by the system ?

i was going to try and claim from packlink but they did deliver it to Lichfield GSP centre,ive decided to send him another ,as no one will help, quite disappointing really 

Pitney Bowes the Shipping Agents should Refund him.
