You don't have to convince us or Ebay!!  Haven't you ever read the Money Back Guarantee, top right of every listing. You just open a Not As Described case to return at seller's expense, for a refund.

I cannot see the damage you are stating from that photo, but photos are not important here. if you have received an item not as described, then open a case for this in the Resolution Centre, link found at the bottom of most pages. Escalate on day 4 if not refunded beforehand. Do not close the case early on any excuse or promise the seller may make, and do not forget to escalate.
