I assume you mean 'Seller is refusing a refund'.
The ebay MBG covers you for 30 days from receipt of the goods. You have longer with a Paypal case but they will only cover items that were received faulty.
If you bought from a business seller in the UK they have a duty to ensure goods are fit for purpose, and if not they should replace or refund. The trouble is getting them to fulfill their duty on ebay, as ebay won't get involved in warranties.
