It is pointless contacting the seller.
Did you actually open a "not as described" case in the resolution centre? When you do so that contacts the seller and lets eBay know that there is a problem. It is important that you do so [you ordered an item in a box and simply got a box = not as described]. If you did open a non-receipt case and the seller can show delivery the case will close but you should be able to open a not as described case. The seller will then send a label to return the empty box [I know I know] and will refund when it is delivered or when delivery is attempted. If not then you escalate ["ask eBay to step in"] after 3 full business days.
