Apple Watch with activation lock

I bought an Apple Watch from eBay which has an activation lock, I tried to contact the seller but he told me that he has followed apple guidelines to unlock it remotely, time has passed since i bought it and nothing has been resolved, he told me to file a return request with eBay so that I can get a refund but I feel it's going to cost me even more! I don't know what I can do please help!

As long as you're still within 30 days of delivery if the seller is in the UK eBay will require them to issue a paid-for return postage label for you to use so you won't have to pay to send it back.

Select "I received an item that does not match the seller's description" on here:

and escalate it to eBay after 3 working days.
