After a mountain of emails, photo's and videos I have received a full refund from the seller of the damaged item. They said they will send a courier to pick the package up. I have asked several times for a return address just in case its different than the one ebay gave me, but without success. They said the courier would call on Mon 22nd. After two days of waiting in for the courier (now Weds 24th) i asked once again when will the courier arrive . Yet again I got another sorry email and they said they will send a return label on the 25th and arrange a new courier. I replied that they are just messing about and if the courier doesnt call bt the 30th I will leave the packge outside my front door. I'm sick of being messed about from the 22nd Feb. Today I received another message reading :- hi sorry again ,or pls close case we resend a new item to you?
you keep 2 items?. What should I do now? I'm just sick and tired that this is still going on.

Did your refund come as the result of opening a case under eBay's money back guarantee?

 

If so, it was eBay's decision and not yours that he had to refund you. It was also eBay's decision whether the item had to be returned first.  As they didn't require this you can do whatever you want with the item. You may want to give the seller a reasonable time to collect it or send a return label, after which you will dispose of it.

 

If you arranged the return privately it's up to both of you to comply with whatever arrangement you agreed. If you didn't set a time limit to collect it would be wise to cooperate with the seller as far as possible in accommodating their timescale. You need to protect yourself from any appearance of trying to keep the item as well as the refund.
