Cancelling a Sale

Not sure if anyone on here can help, or if I need to ask on another board.

 

I bid on a Day Clock for my FIL who has Dementia, and was the highest bidder. Sale ended on 6th August. Just before the end, the seller emailed me saying that she was new to selling and had a problem as the clock had stopped working.

 

I replied asking if it perhaps just needed a new battery? Also said that she needed to cancel the sale if she couldn't get the clock to work.

 

She replied that she had 'contacted supprt' for advice, but it would be 24 - 48 hours before she had a reply.

 

Since then I have emailed asking what is happening, but no reply from her.

Can I cancel the sale, or does she have to do it?

Hi Mags.

 

Only the seller can cancel a transaction once sale has ended.

Ask her to send you a cancellation request form for the purchase you bought ,and accept the request when received "once you have your refund",This way seller can also get her seller fees credited back.

I haven't actually paid for it as she informed me that it was broken before the auction ended.

She could then still open an unpaid item dispute ,so would keep trying to contact for a mutual cancellation request to be sent .

Well I have asked her to cancel the sale, but no reply.

Any suggestions as to what I can do now?

Sadly at this point I would suggest that you pay for the item and then if still no contact or mutual cancellation form sent open an unpaid item dispute.

Learning, you could open an Item Not Received dispute and report the seller as a non-performing seller but obviously, to open the INR, you'd have to pay for the item and leave the dispute, you have to leave that until the estimated delivery time stated in the listing.

Bit of a hard one this Mags as if you pay seller could still send you the broken item which you would then be responsible for returning at your expense for a refund, alternitively your other option is to not pay and if she opens an unpaid item case then contact CS showing them the email you have recieved to say item was broken and appeal against payment being made.

 

How new is the seller  ???

 

Is it worth you requesting her details from Ebay and giving her a phone call ??
