Want to return but seller now partially refunded so now unable to return

I purchased an item that was not as described when received. After almost a week, the seller has confirmed that the listing was incorrect and has now just sent me a partial refund. This has left me with an item I do not want at a price (less partial refund) that is way too expensive for what I'm left with.

Therefore, I want to just return what I've been incorrectly sent and get a full refund. However, due to the sellers actions, I cannot now start a refund as I have already started a case that complained about the item being not as described.

The seller is very slow to respond to messages so now I appear to be stuck with an overpriced an incorrectly described item that I cannot return.

Will I be able to start a return when the partial refund has been processed or do I have any other way of starting a full refund and return process?

you simply escalate the not as described case to eBay to deal with.

The problem is, because the seller has issued a partial refund out of the blue, the case is now closed and I appear to not be able to re-open or create another, hence the frustration.
