Recently I bought a bundle of old games. The pictures were of an old box with all of the games in so couldnt see much, and the title and description explained that these were found in a loft after a move to a new house, and that they are untested and sold as seen.
In the bundle was a very rare game, one of the rarest in fact, that often goes for over 1000 pounds. All that was visible was the spine of the game. I messaged the seller, and they stated they do not know anything about gaming etc. I did not want to alert the seller to the true value of the item, obviously looking to make some money, so I took a risk and bought the bundle, thinking that even if the game is badly damaged, it would still be worth over what I had paid for the entire box.
The box arrived and I was sorely disapointed to find that the game was completely fake, a counterfeit reproduction, and a few other valuable ones are too. Even the games that are genuine, are ALL very heavily damaged in one way or another, and 90% are missing manuals.
The seller does not accept returns, but I have put in a return request. I have attached 10 photos proving the items are counterfeit, and a detailed description along with it.
The seller has rejected this request saying "the items were sold as seen with no description as I am not knowledgeable enough to describe them. The condition of the items was lowest i could choose".
So it looks like I will have to wait for ebay to intervene. Im just wondering what my rights are here. Surely as its counterfeit goods ebay will refund me right? Im worried that they will side with buyer for some reason because they had returns not accepted. It also worries me because I had to do another return just last week which was a similar issue, but one with almost 100 playstation discs that turned out to be scratched to hell and nonreadable. So im kinda worried ebay will see me as a problem buyer or something when im not, i just dont want fake or broken *bleep*!
Bonus annoyance :
The seller also "packaged" the games in an empty lego box with a single bit of string wrapped over the lid. And the lid wasnt even the right lid, it was too big, so it was sliding about, even when royal mail handed it over they said careful because the lids lose. Im surprised royal mail even accepted it!

If you've opened a Not as Described case your seller will have been told by ebay to send you a return label.
If they don't do this you should escalate your case after 3 full working days and ebay will step in and refund you.

Thankyou I do think its a pretty airtight case just a bit worried because seller is trying to worm out of it. Ill have to wait for ebay to intervene.
