What happens here
So I bought a phone of a guy on eBay on Sunday 2nd Feb He sent it I got it Tuesday but the phone has burn in where the navigation buttons are.
He tried to blame me for everything even treatening court LOL
anyway I sent it back he ignored the return all the way except for claiming I damaged it
I have pictures of it
Anyway Ebay did refund me last Tuesday after attempted delivery He still hasn't picked it up or got it redelivered
What happens if the item is sent back to me after 18 days?

In addtion to the advice that you have already been given, if the seller does not appear to want the phone back again, even after you tell him that it has been returned to you following a failed attempt at delivery to his address, then dispose of it as you see fit. However, before you do that, I would suggest messaging the seller with something along the lines of "I have received the phone back again that I returned to you. If you wish to have it sent back to you again, I will return it to you if you pay for the return postage. However, if you do not wish to pay for the phone to be returned to you then I will dispose of it, as I have no use for a damaged phone." That way you've spelled out your position quite clearly and have left the seller with no doubt as to what his choices are, so he shouldn't have any reason to complain if you then end up disposing of the phone if he fails to provide you with the means to return it via a service that he has paid for.

Don't threaten to dispose of it, it makes you look unreasonable.
It only cost him £35 to make a MoneyClaim Online, so you need to be squeaky clean and keep all your correspondence.

Won't do anything with it if he want's to go down the claim route go ahead I have evidence to prove it was not as described as well as all pictures of front back IMEI and everything. It was also sent Special delivery. Phone was boxed up exactly how he sent it to. Funny he went quiet as soon as I asked for the so called evidence he had of it working.
