Replacement item not what expected

I have been dealing with after purchasing a Samsung A55 5G, in Navy with 256Gb of internal storage.  first defect the phone lost any connection to any mobile networks. second defect, phone would constantly go into boot-up, third time the phone was sent back to them the screen would randomly go black and the phone not operate after 20 to 30 seconds.

 

 have had my phone for repairs, or looking into the issues, longer than I have had the phone myself. they have finally provided me with a replacement phone, stating that the phone wouldnt be the same colour but same condition (which assumed would be new).

 

I received the phone today and found faults upon opening the envelope, one security seal had been cut through and a temporary label put in place, the phone did not have it's IMEI/Serial number sticker and the box was dented. 

 

I did get frustrated at finding this as I have been without a properly working personal phone for quite some time after paying decent money for it.  are demanding the return of the replacement phone and will send me the original deffective device back, they also stated that any repairs that have taken place have been a gesture of good will when all their products are advertised as having 12 months sellers warranty, my original phone was purchased in October of 2024, it is now end of June 2025 so it was purchased 8 months ago.

 

I need some help from Ebay in getting this manner resolved as I have had enough of dealing with this shoddy business

Ebay only provide a 30 day Money Back Guarantee and do not get involved with any warranty issues, so there will be little point contacting them.

 

You are also out of time for a payment dispute with your payment provider (You had 30 days from date of delivery for a claim with PayPal and 120 days from date of purchase with your card issuer). 

 

The seller is a registered UK business seller so you can report them to Trading Standards if they are failing to uphold any warranty promised. 

 

If you funded the purchase with a credit card or PayPal Credit and the amount was £100 or more then you might be able to make a 'Section 75' claim although card issuers can decline such a claim as the purchase involved a third party (eBay). 

 

Other than that you are probably looking at a claim through the courts (Money claim) starting with a 'Letter before Action'.
