Refound never arrived

Bought a phone, sold as "pristine conditions".

As soon as I opened it, I found a mark on the case and more scratches on the screen.

I Contacted the seller, he didn't allowed me to return it and offered a partial refound for the mark (he didn't recognized the scratches as an issue).

The description wasn't true.

Never received the refund.

Any suggestions?

Never bother with contacting the seller.  If you think that it was not as described then simply go to the purchase within 30 days and open a "return" case.  Reason "does not match description" add a photo and open the case. Seller will send a label to return and 100% refund.  If he does not [and do not argue at all] then escalate the case after 4 days.    EBay will no doubt refund and may even allow you to keep it.
