Item is not as described

Received not as described item but I have opened a return request changed my mind before I have received the item. I have done this since the seller is a scammer as he listed the same images on multiple accounts. The seller has accepted the return, but I’m afraid he will accuse me of replacing the item, what is your advice to avoid any false accusations from the seller when they receive the returned item.

When you receive the tracked label from the seller, post the item back , and add , if it's not automatically done on posting,  those all important tracking numbers into the case details.

 

On receipt of their item they have 48 hours to refund you,  cases are automatic they cannot dispute the item at that stage and have to refund,  if they don't,  when that time lapses escalate the case,  ask eBay to step in, and they'll force the refund.

 

Not sure why you think the seller is a scammer because the same item is being listed on different platforms. eBay have a duplication policy that is, the same item cannot be listed several times at the same time, so this seller having more than one item, he uses other platforms, all seems above board there.

 

Your seller accepted the case promptly,  I cannot see why he should judge the item  when received,  as a different to the one sent out, or accuse you of swopping the item ? 🤔

 

You just need to remember to escalate,  if they do not refund you.

The problem is I had the feeling he is scammer as of the multiple listings of the same iPhone and the same serial number and even same images. After one day or so, I couldn’t stand still and wait until the scamming happens, I went and started a return request under ‘changed my mind’ reason. After I received it today, I got a totally different iPhone package that is old I think it is 12 and I ordered 16 pro max. The package was totally different from the listing. 

I wanted to return it under ‘not as described’ but I have already started a return and I’m afraid the seller will say that I have changed my mind to swap the iPhone and accuse me of doing so.

Can you explain what you mean you received it but opened a case for change of mind before you received it ?

Sorry for the confused writing.
After I paid, I suddenly come across the same exact image of the device I bought, which is listed on another account. Since then, I was worried and alarmed and I couldn’t rest assured. After that, I went and started a return under ‘change my mind’ reason. Today, I have received the iPhone which is not as listed (iPhone 16 pro max), and turned out to be an older model package (I think 12) that is even empty, just a package. This is another level of scamming.

You have started a return so follow the procedure.

 

You need to return the phone promptly.

Use a tracked service and make sure you add the tracking to the case and hold onto your proof of posting showing the seller's postcode, the weight of the item etc.

Although you think the seller is a scammer, it sounds as if they are a business seller, presumably with decent feedback or you would not have bought from them.

 

It is never a good idea to open a return case before you receive your item.  Alongside the very limited feedback on your account, the seller may be as suspicious of you as you are of them.

The few feedback on my page is because I haven’t used eBay that much since 2019. 

I am an Amazon buyer all the time. 


After this case, I’m going to my idleness state again since it is terrifying and full of anxiety buying experience.

As you already have a change of mind returns case open you cannot change the reason or open a different eBay case.

You jumped before you were pushed, sums it up.

If you had waited for the phone to arrive then you could have then opened a "not as described" case and you would have been guaranteed your money back.

The seller has accepted the return request, is there a chance he will refund, or otherwise eBay will step in? Is this scenario still possible?

The seller does not have to refund you until you have returned the item that you bought.

As you chose a 'change of mind' return, you will have to send the item back using a tracked service and add the tracking to Ebay.

Until you do that, and the tracking shows the item is back with the seller, they don't have to do anything.

 

You seem to be saying you received an empty box.  You will have to return that the the seller. What action they will take when they get an empty box back instead of the phone they sold to you is anybody's guess.

Personally, I don't think they will immediately send you a refund on receipt of an empty box.
