Help with a refund

I bought a phone on the 22nd September. The seller told me, after I'd paid, that it wasn't charging. He tried to refund me but was told the refund couldn't go through. I tried to cancel it but was told by ebay that I couldn't do anything until I hadn't received the item. Which was Sunday. Then I could file a 'I haven't got my item' and he could refund me. However I did my end and ebay still wouldn't let him refund me. It says my end that I will be automatically refunded by ebay on the 3rd and his end says there is an issue with the refund. I just want me money back, he just wants to give me my money back. I don't understand why my money is being kept hostage by ebay for 2 weeks. Any ideas on how to get it to move a bit faster maybe?

Help with a refund

You really  need to open an Item Not Received dispute which you can do from your buying history on the drop down menu to the right.

Seller can refund through the case at any time, but if he still hasn't done by the 4th day, escalate to ebay who will enforce a refund.

If you then receive the phone you need to open a return using the reason: Item not as described and if the seller wants it back he will send you a return label and refund you on return. If for any reason the seller doesn't either refund or send a label. escalate to ebay on day 4 to get refunded.
