Fraudulent fruit seller

I ordered some tropical fruit on eBay yesterday without checking the sellers feedback. They are advertising the African cherry apple. The pictures in the listing looked AI generated. I got an email 2 minutes later, stating my order was being packaged. I then got an email message from the seller stating that the fruit was rotten and they will send my order in a weeks time when they get more stock. She attached photos of boxes of rotten fruit in her home. 

 

I looked at her feedback and 5 buyers have left negative feedback in the last month due to receiving rotten fruit. The seller must of immediately selected that the package was being created in order to obtain the funds held by eBay.

 

What should I do in this situation.

You can ask the seller to cancel your order,  but they do not have to oblige.

 

If they don't cancel , then wait one day after the item's last estimated date for delivery and proceed this way....

 

Go right of the item purchased,  and from More Actions select....  I Have Not Received My Item.

If you are not fully refunded within 3 days,  you must escalate the case on day 4 or within 30 days from opening the case,  and eBay will step in and force the refund.

Do not close the case early for any excuse or promise the seller may give,  and do not forget to escalate.

 

Leave appropriate feedback too,  to warn others.

I asked for a refund. The seller responded, stating that they have refunded, but haven't. I'll have to wait and open a case.

Don't wait, time is of the essence when opening a case.

 

Don't believe the seller has refunded,  just open that case now, and escalate if necessary as I explained above.

 

Only when you receive an eBay message to say a refund is being processed, can you be guaranteed of that refund.

The refund went through and she posted a screen grab of it processing. I advised her to pull the listing until she had fresh fruit.  I can't get my head around her getting 5 negative feedbacks with photos of rotten fruit within one month. Poor show.

 

I know she has been bad, but I'll go ahead and give her a chance to recifiy. I'll re-order when she has it fresh. She has been open and detailed in her replies. I want to taste this fruit. A YouTuber has said it was the best fruit she has ever tasted! A cross between sour cherry and brown sugar. I'll see how it goes. I want to grab it before  it goes out of season 😄
