I bought an item over 10 dayx ago which has not been sent. I raised a query with seller who has said I was aware they were away until the 5th April and I said I would wait. I have had no communication from the seller at all and was not aware I would have to wait is this allowed?

What was the last estimated date for delivery?  You can open a case for item not received,  one day after that date,  though probably wise to wait a few more days as the post is not being reliable for some,  to be on time,  and those are just eBay's estimates,  being a tad optimistic.

 

Was there a message across the top of the listing to say .....  ' Seller away until 5th April'  ?  Only Business sellers have this option of leaving such a message.

Last date for delivery was a couple of days ago. I have opened a case and seller responded that I knew he couldn't post until the 5th April. I did not know so am confused by this. Thanks

Then,  when a reasonable time passes your item's last estimated date for delivery message the seller no more,  just proceed this way.....

 

Go right of the item purchased,  and from More Actions select....  I Have Not Received My Item.

If you are not fully refunded within 3 days,  you must escalate the case on day 4 or within 30 days from opening the case,  and eBay will step in and force the refund.

Do not close the case early for any excuse or promise the seller may give,  and do not forget to escalate.

I have opened a case and got the message on the case saying I knew they were away . How would I know with nothing on listing and no communication from the seller.  Thanks

Ignore that message,  if a case is opened,  the seller has 3 days to refund you and it is timed to the second,  so on day 4 after opening if there has been no refund,  the option to escalate,  to ask eBay to step in, should appear.

 

Escalate, and eBay will force the refund.

 

Do not close the case early,  no matter what the seller says or promises,  and don't forget to escalate if there's been no refund beforehand.
