In case you are not already aware of it, these forums are not a direct means of contacting eBay. The only people replying to threads on these forums are people just like yourself, who buy and/or sell on the site. However, if you were to give us some more information about the circumstances relating to the matter you posted about, then it would be a lot easier for people responding to your post to give you far more accurate suggestions as to how to resolve the matter based on the circumstances relating to the case.
If you have not already opened an eBay case then open one now, selecting the appropriate reason as to why you are opening the case - eg: Item Not Received, Item Not As Described, etc... If the seller fails to resolve the matter within four working days from the date that you opened the case an extra blue button will appear in the case details, which gives you the option to escalate the case to eBay. Should you need to get eBay involved in order to secure a refund then click on that blue button - once eBay get involved they will more than likely issue you with a total refund unless the seller can provide evidence to sway eBay's decision in his or her favour.
With regards to the possibility of eBay deciding the case in the seller's favour, there are a few reasons as to why this may end up being the case. One such exception where eBay may decide the matter in the seller's favour would be if you opened an Item Not Received case and the seller was able to prove beyond all reasonable doubt that the tracking details showed attempted or successful delivery of the item to the address that you provided at Checkout. Another example in which you could end up losing the case would be if you opened it and allowed it to time out. If that were to happen then eBay would not allow you to open another case in relation to the same transaction, as if you left it so long that the case automatically timed out and closed on you eBay would assume that you had managed to resolve the matter amicably with the seller.
