Have you actually opened a not as described case through the resolution centre.

"What the seller says" is not relevant and may simply be designed to mislead [tsk tsk]

If so the seller sends the label through the case and you print it off and send it back.  The seller gets only 3 days to supply the label and if he does not you escalate the case to eBay who may not even require a return.

You must open a case every time. Simply sending it back will get you no money

Personally I'd advise you to do as has already been advised and escalate the case to eBay.  If the seller has failed to send you a valid returns label and has still not refunded your money then you should escalate the matter to eBay in order to allow them to make a decision upon the case.  The most likely outcome is that eBay will more than likely assume that the seller doesn't actually want the item back given that he hasn't provided you with a valid returns label, in which case eBay will just force the refund and you won't be required to return the item to the seller.

The seller. Just escalate the return request or case to Ebay on the date shown.

Escalate the Case for EBay to Step In they will issue the Label or may just Refund without you having to Return the Fake Item.
