Hi everyone i am really stuck here. I won an auction for a transit van, i now have the van and notice almost everything is not as described. Ebay cant help because i paid by bank transfer, banks cant help because i used bank transfer and not card. An unpaid item case was automatically opened on me even though i paid by bank transfer. Now i cant even leave negative feedback to warn others because i had an unpaid case.
Any help would be great as i am tearing my hair out.

Why don't you read the MBG. Vehicles are not covered in any circumstances,however you pay. Paying by bank Transfer should only be made AFTER you have fully inspected the Vehicle, as there is no way of getting te money back.
Why ever did you let the Unpaid Case complete, seller has your money and has had the selling fee refunded. He should have marked as paid, you should have appealed to ebay, he has conned you into buying a rubbish vehicle and defrauded ebay of the selling fee.
It is worth having a word with ebay, or entering "Appeal an Unpaid strike" into Help & Contact. You may be out of time, but still worth trying.
Just to let you know that Trading Standards can't help you get your money back if that's what you're hoping. That's not what they do. And they can only investigate the seller if he's actually a trader. A private seller selling off his own no-longer-wanted vehicle has nothing to do with Trading Standards.
I'm afraid all you can do is treat this as an expensive learning curve, and never again pay for a vehicle untill you've fully examined and tested it, and carried out all necessary checks. There is no buyer protection anywhere on used vehicles sold by private sellers, regardless of how you pay - the law states 'caveat emptor' (buyer be aware).

Buying a vehicle on eBay should be no different to buying a vehicle from a advert in a paper.
You do not part with a penny until you have been to view the vehicle and had a test drive and checked and double checked everything is in order.
Only then do you part with your money.
As yo have found CAB, your bank, and eBay cannot interfere with the transaction, especially if the seller is not running a used vehicle business.
You may have one thing in your favour.. The seller has opened a non payment claim for the van.. Therefore the transaction has not been completed, therfore your bank should refund you as its obviously gone to a wrong payee.. Send that to your seller and see what he does.
