Purchased item, seller sent to different address however shows as delivered and signed for.

Hi

I purchased a piece of jewellery which was sent out first class signed for not tracked

It was marked as delivered and signed for today however it was not delivered to me or signed by me

I contacted Royal Mail with the tracking number and they confirmed it was not my address on the package.

I suspect this is fraud from the seller

Any advise on where i stand or following action i should take, i have raised the issue with PayPal

In those circumstances you need to open an Item Not Received Case with Ebay. You haven't actually opened one with PayPal have you?

Contact Royal Mail and ask them to Confirm in Writing that the Item was not Delivered to your address. Send a copy through the Case Notes to EBay or PayPal depending who you have Opened a Case with.

@reg_coop if you haven't opened a Paypal case open one in ebay first.

I opened a PayPal dispute first, I was unsure of my best course of action and took that road.
I was not sure if i could mark it as not received on Ebay as it shows as delivered via the tracking information

Ah, I thought so. In that case I repeat: Stick with the case.

If you have raised a case with Paypal you cannot now open a not received case with ebay so you'll have to stick with the case.

Where was the item sent to? For the seller to be covered by seller protection they have to send to the address on your Paypal registration. Was it sent to this address?  If so the seller has done nothing wrong.

If the seller sent to any other address you have a case for item not received and you should win your case.

I contacted Royal Mail who confirmed that it was not sent to my address, they can not tell me the address that pertains to the tracking number because of data protection but they were clear that it was sent else where

Sounds about right. Ask your seller where he sent it to. You'll have a better idea.

My concern is that it shows as delivered on Ebay and the Royal Mail site even though it was not to my address, the only proof i have that i did not receive it is a phone call to Royal Mail
I presume the responsibility is on the seller to prove he sent it to my address?

As I say the seller has to send it to the address Paypal tell him to. If you have your correct address on your registration but the seller has sent it to a completely different one you should win the case.

It is my understanding that the printed receipt from the post office that they have should bring light to this situation
I am trying to get something in writing from Royal Mail stating that the address differ and i did not receive it

My next port of call is my local depot tomorrow morning to see if I can get something in writing stating that tracking number does not have my address on it.
That should be the smoking gun

A little update

I have just noticed in my hurry earlier I opened the case with PayPal as ‘item not as described’
This was an error on my part

Should this matter?

Yes it matters because an item not as described case means you have to return the item but you don't have an item to return.
