So I bought a mirror from a seller on Ebay for £20 + £10 postage. I would assume as a seller it is their responsisbilty over the item and this mirror has arrived broken. I contacted the seller and he has raised a claim with hermes hoping to get £20 for the claim to pay me with. he has offered to pay me £10 for the cost of postage but will not pay me the other £20 unless hermes pay it to him first...
in my view he should be paying me £30 and just wait and hope on his end that hermes accept his claim and pay him the £20 whenever that happens if it does.
Is it wrong of me to expect a full refund for this? the mirror will have to be thrown away as it is not safe to use so i dont want to have paid £20 for litterally nothing.
What are your thought? how should i resolve this issue?
you need to go to the Resolution Centre and open an item not as described case,
the seller cannot make you wait for a refund,
Foolish seller, you can if he doesn't refund get ebay to force it. Have you read the Money Back Guarantee on every ad. It means what it says, seller will have to refund you either voluntary or forced.
He has also never read HermesT & C, basically if an item is breakable they don't pay any compensation.
This is going to be an expensive lesson for the seller, as if you have to involve ebay, he gets a damaging defect on his selling account and STILL has to pay the selling fee as well as refunding in full.
The seller doesn't know what he's doing. He cannot lodge a successful claim with a carrier until he can prove that he has refunded the buyer in full. Full refund to buyer comes first.
In any case, the mirror may not be covered by Hermes, so his claim will fail anyway. But that is his problem, not yours - sellers are responsible for finding a carrier that will cover the item in the event of loss or damage (and most breakables are not covered).
Read Ebay's Money Back Guarantee - on every listing and in various other places across the site - to learn how to open a Not As Described case. If the seller does not resolve the problem, ie. refund you in full as packages containing broken glass cannot be handled by carriers and therefore returned, escalate the case to Ebay on the date shown (which will be 8 x 24 hours after case-opening) and they will force a full refund of the whole of your original payment.
DO NOT close the case on a promise. Closed cases cannot be reopened, and you cannot open another.
