The seller keeps stating that my oreder was delivered and gave me tracking number, but I have never received the order!

I guess the courier deliverd it to another person, but I cannot find him!

So it means I have lost my money and have no order!

What can you advise me please? How to return my money?

Unfortunately eBay can only go by the tracking so if that shows delivery you would not win a "not received" case.   Ask the seller if they will take it up with the courier to try and find out where exactly it was delivered.   Ask all your neighbours.  If still no luck if you used your credit or visa debit card with or without Paypal ring your card provider and see if they can help.

EBay plays down the risks of buying here, but this is one of them.

Your experience is increasingly common, especially with the proliferation of budget couriers. The problem is that anyone can sign for parcels, it doesn't have to be you. Some delivery services don't even require a signature. Parcels may be delivered and signed for with neighbours, or at the wrong address, or left in a "safe place" to be lost or stolen. Doorstep theft of parcels is soaring (in the US, this is known as "porch piracy!").

EBay can't and doesn't attempt to investigate deliveries. They require the seller to provide a valid tracking number that confirms delivery to your address. If it does, the case will be closed in their favour. Both you and the seller have accepted this policy as part of the user agreement - and to accept eBay's decisions.

 

EBay requires the sender to upload the tracking number, so unless you have done so already you should be able to check it online. It's required to be delivered to your address, so if it shows that it was delivered elsewhere you can appeal the decision. From accounts we've received, eBay can be very lazy about checking the details. At least one buyer has told us that eBay accepted proof of delivery "somewhere in their postcode area" as sufficient!

First of all, open an Item Not Received case via eBay.  If the seller cannot prove that the item was delivered then you should receive a full refund of the money that you paid for the item, whether the seller refunds you voluntarily or not.  If the seller will not refund your money then escalate the case to eBay to make a decision upon.  If the tracking proves that the item was never delivered then eBay ought to receive your money; however, there have been several cases in the past where eBay have just taken a quick look at the tracking and so long as it proves that it was delivered they'll decide the matter in the seller's favour, even if the item was delivered to the wrong address!

 

In the event that you open an Item Not Received case in the eBay Resolution Centre but eBay decide the matter in the seller's favour then open an Item Not As Described case via PayPal.  PayPal tend to check cases far more closely than eBay do, and if the tracking does not show that the item was delivered to the address that PayPal told the seller to post the item to when they sent him the confirmation of payment e-mail then you would receive a 100% refund of the money that you paid for the item.  You get one hundred and eighty days from the date of payment to open a PayPal case, as opposed to thirty days from the last estimated date of delivery to open an eBay case, so you've got plenty of time left.  However, you cannot open two cases simultaneously in relation to the same transaction, and although you can open an eBay case and then open a PayPal case at a later date in relation to the same transaction you cannot open a PayPal case first and then open an eBay case, so open an eBay case first and leave the PayPal case as a back-up option in case something goes wrong and you lose the eBay case.

 

If you do end up having to go down the PayPal route make sure that you escalate the case after two days but before the twenty day cut-off point.  If you fail to escalate the case before the twenty day cut-off point then you won't be able to open another case in relation to the same transaction and you won't get your money back.  However, if you do have to open a PayPal case to get your money back then so long as you escalate the case in time and the seller can't prove successful delivery to your address then your payment will be refunded in full.
