I understand due to the market eBay moved to a free listing model for private sellers to remain competitive, they have repeadly pushed and I've been lead to believe there will be more of a crackdown on business sellers selling under private accounts.
It appears emails have been going out left right a centre telling 'private' they are operating as a business and they have 30 days to convert to a business account or they *may* face restrictions.
This is all and well except im yet to come across a single person that has been given any restriction for not doing so? I cant count on both hands the amount of people I know that have received this email, in some cases months ago and have continued selling privatly, to the tunes of 000's in sales and still nothing.
Am I the fool here?

Why would you be the fool?
I'm guessing that you are actually a business who was trading as private and made the change to business.
In which case NO, your not a fool, you are complying with the law.
Those who are trading as private are the fools. As they are playing with fire and could find themselves prosecuted at some point. Particularly as many sellers will report them to trading standards.

I moved to business last year but as with many, its growingly frustrating that eBay do not do anything about this. Seems to be all talk and no substance.
They should be reported and hope people continue to do so but unfortunetly this will do nothing until its stopped at its source but it appears ebay have put on this guise of doing something but in reality no real action is being taken.

All you can do yourself is report the seller NOT their listings, you can do it here Online Customer Service - Report an issue with a seller
Click the bottom choice : The seller has violated one of eBay’s policies then either: Seller’s contact information isn't correct or Other.
Use as much info as you can and write it like communicating with a child.

No, it won't do nothing reporting them.
The more people do, the more likely it is that something will be done about it.
And has been said before, you also can report them to both HMRC (though this may not be effective) and to Trading standards.
And if you are that fed up of it, contact your local MP over the issue. The more people that do, the more likely some sort of action will happen.
I have zero tolerance now for anyone flagrantly trading and they are reported to both Ebay and Trading standards.

There's a few cheeky ones adding text to their listings telling buyers where they are selling off site to get round BPF and SD.
