Hi

As far as I can tell, if you sell items that have been available in Europe before the 13th December there is no requirement for all this "Safety" information. So every second hand item on Ebay UK on the 12th of December is ok. I am not so sure about new items but the regs seem to infer that these as well are exempt from this. So before you panic read these two paragraphs from Ebay's instructions.

 

Ebay's explanation says this:-

 

There’s no exemption for products whose manufacturer no longer exists. However, according to Article 51 of the GPSR, products that were first supplied to the EU market before December 13, 2024, and comply with the General Product Safety Directive (2001/95/EG), can continue to be sold without adding GPSR-required information in listings. This applies even if the manufacturer has gone out of business. For example, if you're selling a compliant product that was made available in the EU before the specified date, you don't need to include GPSR-related information, such as the manufacturer's details, in your listing. You may still have informational obligations under other regulations.

 

Article 51 of the GPSR is also applicable if you sell second-hand products that were first supplied to the EU market before December 13, 2024, and comply with the General Product Safety Directive (2001/95/EG). For these products, you’re not required to provide GPSR-required information in your listings. However, you may still have informational obligations under other regulations. We encourage you to add any GPSR-related information to your listings if you believe it’s necessary. 

 

The last sentace of this is very interesting and is an attempt to transfer the responsibility to the seller as usual.

 

Maybe Ebay haven't read their own instructions.

I think that sellers of secondhand products should let the public know of any issues they are aware of which could be harmful. It's quite depressing and worrying as so many products do contain toxins. Beautiful bright green Victorian textiles and books can have arsenic. Even if uranium glass and glazes are not radioactive, the heavy metal oxide is toxic. Old horsehair stuffing on furniture can harbour the spores of anthrax (an historian once assured me although I've never heard of a case in the news).
