Suspect item sold may be stolen

Hi - Any help with this would be appreciated!

I have an unpaid item case raised against me for an Iphone 5 which was purchased on ebay by my son. The item in question was described as working but locked to an Icloud account. When I have investigated this further this means that the phone is unusable unless it is unlocked from the account to which it is locked to.

My concern is that the phone is stolen or reported as missing. To unlock the phone it is possible to find the account to which the phone is linked to, and I am concerned that this will cause me some explaining as to how i came to aquire the phone - I really don't want to get involved in anything like this!

I contacted the seller and I have offered to repay any costs incurred with relisting the item.

Do i have a legitimate reason for not for not paying - or is the general feeling that I have committed to purchase the item?
