Poor customer service.

So my daughter returned a phone 4 weeks ago. I have had a lot of communication with the company. With numerous issues along the way. It has all been done via eBay. We were promised the phone would arrive Friday (2nd December) and of course it wasn't delivered. How do I go about contacting eBay as quite frankly I have had enough. I did ask for a refund but as I said they promised the phone would be delivered.
Please advise.....
