Items have to be manually listed not auto relisted, and only during the promotion's duration. Items already listed and then sold after the promotion is activated do not comply.
It also has to sell within it's first cycle of listing.
If you still think the promotion should have been applied, contact eBay Customer Services, they have full access to your account and if an over charrge of fees has been made they can refund this for you.
