A Ebay member has used my photos for their listing.

Hello. This can't be right surly. I have been browsing the site, and I couldn't believe my eyes. I've just noticed another ebay member has stolen my photos. What I've sold is a one off, so very unlikely they would have the same. I have also a few days ago sent this item off, and its gone overseas. I've reported and complained to ebay, but nothing as yet. I believe their is something fraudulent about this member. There are nearly 140  items they have for sale, and each photo does not look to be in the same surroundings ?

eBay just recommend that you contact the seller and ask them not to use your photo but, to be honest, I can see little point in this, particularly as it's a one off and if the item is sold and doesn't match your photo then the buyer is going to return it under eBay's Money Back Guarantee at the sellers expense.

Is this seller in the same place as where you posted the item to?

Could they just be selling it on?

 

Any idea how long this similar listing has been there?

It s in the agreement we signed to sell on here that others can use our photos on their listings, eBay can do too for their library of photos if they wish.

 

Whilst it would be nice and polite for a seller to ask ' permission' it's not mandatory to do so and even if you said no, they could still go ahead and use the photos.

 

Personally,  I think it's a little lazy of a seller to do this and also opens themselves up for a possible item not as described case,  as it's not showing the actual item for sale.

Don't eBay sell/have rights to any photos we upload?

I think I remember reading a post from a really annoyed user where eBay had allowed another company to use his photos.

And it seems to be a rolling argument among the postcard/print sellers too.

Hi, no its another area. Mine has only just been posted to Northern Ireland. This listing is around Birmingham. Their listing number is 306147824582.mine was 176871543683Their listing is on buy it now, so no idea when listed. Also more to the point, its my photos, without my permission

Unfortunately, a member does not have to give permission for another member to use their photos, as in my post above,  I personally think it's polite to ask, but even if the answer is No,  the seller can still go ahead and use the photos.

Sorry, not directly related to this thread but another you just posted on in member to member support. The one about the necklace. Isn't that supposed to be an "action fraud number" type case?

There was a drone one yesterday where the buyer is said to have broken it and everyone was saying action fraud.

I think an action fraud case is for when a different item is returned, not for damaged items.

So even though a link is said to have been removed from the chain, that's still classed as the same item, damaged not different?

Cannot find the exact post, seem to remember the drone , but not sure if either are cases for Action Fraud. 

 

I know many members do say contact AF,  no harm,  they can either say yeah or that it's not a case for them.

I've just had a look at the item you mentioned and from that looked at their other items, one I looked at is definitely a copied photo from another user as I found the item they copied it from.

 

The account was only opened at the end of December last year, and they only have about 83% positive rating. It looks like it would be lower but because EBay now add a positive for new accounts if they have sold something and the buyer hasn't left feedback.

 

You are right something does seem a bit off about the account.

Maybe get an ebay friend to message him and ask for a specific part to be photographed.  Just to see if they squirm at the request...not that that helps the situation.

 

With OOAK items I want to see the exact item I'm buying, not a stock photo, esp if the item is second hand/vintage.

 

In early ebay days you could ask ebay to remove your photos from other sellers' listings.  I used to watermark mine with my user name but we aren't allowed to do that anymore either.  Yes I am an old has been.

Yes, its still the same item. Some buyers return a completely different item or even an empty box.

Yes I used to put an image of my profile with my user name and that seemed to work. I may have to try that again. I remember just recently I listed something, and I couldn't list it, because I had a message that the image was similar to one already on there.

Good idea, although if the seller is too lazy to take their own photos, they will be the sort who ignore messages - especially if they ask awkward questions!

Yes, There is a lot of items. The items photos seemed to be pictured at different houses. My jacket, is on a proper adjustable dummy. Any seller who has a dummy like mine, would use it on most of all clothes they are selling ?
