As a member since 2004 I am pretty sure that I actively opted out of the catalogue in 2009 which was an opt out option when Ebay first released it. 


I forgot all about this potential image storage catalogue and any potential involvement in it until I noticed a listing containing all my images a few days ago. I asked Ebay to remove my images from that listing. I asked the Seller to remove my images. Neither have done so. 


I am now seeking advice because I strongly object to this for so many reasons. A long and unhelpful 45 min call to an advisor who did her best but said "you cant determine who is the originator of the image"  obviously has not helped my frustration and disappointment. Thoughts - I feel abused - am I alone in this? Anyone else opted out to find they have been opted in ?

Ebay allow this.

When you sell on the site, you tacitly agree to everything in the user agreement, including allowing other members to use your images.

 

What should I do if my image, video or text is being used by another seller?

When you create listings you give eBay and its customers permission, through our User Agreement, to use your images, videos and product details. Your content may be added to the eBay product catalogue, and may be used by other sellers in their eBay listings.

1  I opted out in 2009- If I actively opted out -as was the option in 2009 originally - surely that opt out should not be overridden or turned into an opt in without my consent? 

2They are not identical  - I am selling clothes which are similar but not identical - when I questioned this image inconsistency  I was told by Ebay that the onus is on the person using my images of my unique - individual items to make sure they were exactly the same. But they are obviously not identical so how and why can they be shared? 

3 watermarking - I was then told to watermark my images - but Ebay specifically requests that you don't watermark your images - I think for advertising off site. 

4 copyright - my photographs - the images I take - are covered under UK copyright law and dont need to be watermarked to be copyrighted. 

5 proving ownership of images - Ebay also said I cant prove these are my images without a copyright watermark-  which is untrue - I can prove these images are originally mine. 

It would be helpful to have a direct response from Ebay about these individual points 1-5 - as I am really confused - especially as there is a record of my opt out in 2009.

You would need to contact Ebay with your individual points.

Even if you originally opted out, it is worth knowing that every time the User Agreement is updated all the new terms and conditions automatically apply to all users.
