Partial instead of full refund. Was I foolishly misled in not opening a case against the seller?

I am hoping that this will act as a warning to all the nice, honest Ebayers out there not to fall into the trap I have found myself in.

I recently bought a garment which had been considerably altered from the original, a fact which had not been declared by the seller. All the seams and godet pleats had been topstitched 'zigzagged' and not evenly.

The private seller did not take returns but when I expressed disappointment with the condition she immediately offered me a FULL REFUND.

Because of this generous reaction , I did not open an e-bay case but immediately returned the garment at my own expense.

In the listing she had stated 24 hour tracked. It was delivered 3 days late 48 hour tracked but I did not quibble.

Extensive and lengthy communications throughout the delay ( of  over 3 days )were warm and positive, and when I returned it, it was back with the seller in 48 hours, within 4 working days of my receiving it at week-end.

I received only a partial refund, broken down in my account as part for the garment, and part for postage I paid to the seller. She is now stating that the return was accepted as a goodwill gesture, and as far as she is concerned it is the end of the matter.

All our communications are through Ebay messages and fully recorded.

BUT .. Because I did not open a case with Ebay and a partial refund has been paid there appears to be no way of securing the £4.19 postage charge from the seller.

My payment provider would have to secure any underpayment from ebay commerce as they are the intermediary through which payments and refunds are paid.

Do I grin and bear it having paid 2 lots of postage for no benefit? Lesson learned....do not trust anyone...do not behave nicely. Or is it worth pursuing via Paypal?

I fully realise my mistake was not to open a case! Has anyone had a similar experience , resorted to Paypal and been successful?

Are you still within time for an ebay case?  Have you tried to open one or contacted ebay about opening one for you to get the balance of the original payment?

 

No-one is going to get you the return postage back.

unfortunately you should have opened a not as described case and the seller would have had to pay for the return and hive you a full refund.

 

PayPal have the same time limits as eBay for a not as described case.
