I have been scammed seller wiped item from ebay then i could not open a dispute

This is fraud I have been scammed I purchased an item found it did not work asked for a refund Then the seller some how wiped the item from eBay as if it never existed all the communications were also wiped   I have proof that the item was delivered. and a letter from the seller thanking me for the purchase

Question has this  happened to any one else If so how do you open a dispute when the item has been wiped
