Faulty Sofa

Purchased a sofa from Ebay from a BUSINESS SELLER and its faulty after 5 months its collapsing on one side. they are refusing to do anything about it as outside of the 90 days. What are my options as CANNOT get through to a human on chatbot

You're out of time to do anything via eBay, buyers have 30 days to open a return case.

 

However, if you funded that payment with a debit or credit card you have 120 days from payment to issue a not as described chargeback. Are you past that too?

 

If so, and your seller is a UK registered business seller, you may want to consider a legal claim.

What are my options

 

None through eBay. eBay's own money back guarantee only lasts for 30 days. From day 31 eBay will not be involved, whatever the problem. You accepted this in the user agreement.

 

Your dispute is now with the seller. If they are refusing to do anything about it then depending upon how you paid your payment provider e.g. credit or debit card issuer may be able to help.

 

Failing this, as your seller is a UK business seller you should have some statutory consumer rights. However, having rights doesn't count for much unless you re able to successfully enforce them, which may be difficult or pointless against distant, uncooperative sellers on eBay. I suggest that you consult citizen's advice or a solicitor before going down the legal road.

 

eBay warns buyers that they don't guarantee the quality of items sold here, or that they will be truthfully described, safe, legal or even exist. Would you have bought a sofa from a shop that stated this? Buying from unknown sellers on eBay is not like buying from the shops. eBay is a jungle.

Yes I am. It’s a brand new sofa. Surely it should be covered by something. A sofa shouldn’t collapse after 5 months. Been totally ripped off by the seller and eBay

eBay have not ripped you off,  as they are not the seller,  just a selling platform.  They offer a 30 day Money Back Guarantee policy for a full refund when receiving faulty goods, but, it has to be claimed within 30 days.

 

eBay see none of their 7 billion plus listings,  so cannot give any guarantees the items sold,  will be fit for purpose months after purchase.

 

  There's a lot of trust involved when buying online,  trust that the seller is abiding by eBay's rules that they are truthfully describing their items.

 

You bought from a UK business, contact Citizens Advice how to proceed here,  they will give you sound advice what to do next!
