Buyer issues

I have a buyer who purchased a used Lego set. I made it clear on the description it was sold as seen and parts missing. Photographed everything so they knew exactly what they were getting. Probably 95% there. Description says sold as seen. Item was shipped fully assembled as per the images in loads of bubble wrap.

 

Over a week after delivery, I get a return request. Saying there are parts missing (despite them knowing that already!) I have reluctantly accepted the return request as I know eBay will just come down on the side of the buyer.

 

However, they sent me a picture of it and it’s now fully broken apart and looks like half of it is missing. 

According to eBay’s return policy, items should be returned unused and as supplied. I feel this buyer has just changed their mind and trying to pull a fast one. I have asked them to return in the original assembled condition but they are refusing to.

 

So I am just going to get a pile of bricks back and no way of knowing if everything I shipped is there without having to reassemble it myself. 

Should I deduct from refund for return being used and not as supplied?

Sold as seen does not apply on ebay.

How can buyer see it before paying.

You will have to refund in full on return.

Only business sellers may be able to deduct some money.

All you can do here is to wait until you have your item back, and then report the buyer if they've taken pieces from it.

If the buyer opens a return request and sends back the item at your expense using a prepaid return label you will be expected to supply, and its no longer in the same condition as you sent out,and the buyer wins the case,you as the seller can appeal the decision here Appeal the outcome of a case as a seller | eBay

Best to be aware that most cases/appeals do go in the byers favour.

The seller would need to let eBay make the decision in order to be able to appeal though, which risks a damaging defect against their account.

Hopefully the seller wins then.
