item not as described

Hi after a bit of help please..

I bought an Acer Notebook. It was advertised as good  working order.

when it turned up it had scratches which were not mentioned, doesn't work if it isn't plugged in  (as soon as plug comes out it turns off) and you can't get online with it.

I have contacted the seller and they said it was working fine before they sent it and that if it's only the battery then i can buy a new, cheap one off ebay or just use it plugged in ... i told them i didnt want to spend any more money on it  and they replied with "well you got it at a bargain so it will be worth spending more money on" and then they said they will give me a refund but not till the end of the month. So can i have some ideas on what to do now please?
