can someone use my listing photos for their own listing?

I listed and sold an item on ebay, and now find someone else, not me nor my buyer, is using some of the photos I took and used, together with my listing title, word for word. Can this person do this legitimately, and does it lead you to think something possibly untoward is happening? The seller only has 2 feedbacks,

Probably just a lazy seller.Your photos may be in Ebay's Catalogue and can be use for others. 

Seller being new saw your listing and in case you have never noticed it doessay on listings something like " Got one like this"  or "sell one like this".

Clicking on the link will give you more or less the same as if you click on RELIST or sell similar. All the basics are there, a sensible seller would add their own pics. and edit the wording.
