Return that never happened

I sold a victirian crystal glass vase with 14 prisms attached to a buyer in France. The vase section arrived broken and she requested a refund. Photos were sent and I have started a claim with the courier. I also said that I would refund upon receipt of the 14 prisms(were not broken) which I could then resell and recoup some of my losses. I also said I would pay the return postage. I have a 14 day return rule.

No reply from the buyer despite repeated requests. Took the case to Ebay service resolution and they found in favour of the buyer and I was not entitled to get the goods back as they are apparently hazerdous. The buyer apparently produced documentation to say they were hazardous which I have not seen. As far as I am concerned they are my property as I have refunded and since when does ebay decide on legal ownership or rewrite the laws of a free country.

Regarding hazardous we have a wonderful product called BUBBLE WRAP and PLASTIC AIRBAGS together with a strong item called a cardboard box. I send fragile items all over the world as my feedback will reveal and have a really good reputation for safe secure packing.

It has gone to appeal but not holding my breath.

This has destroyed my faith in Ebay and I think I am going to close my account and just do the antique fairs in the future. I have been trading on ebau since 2003.

PLEASE NOTE THE PRISMS WERE NOT BROKEN AND SIUTABLE FOR SHIPPING. I didn`t ask for the broken glass to be returned.
