I purchased a pair of shoes listed as size 6, however they were actually a size 6.5 or 7 and did not fit me. I began a return using reason 'doesn't fit' and explained they were incorrectly described. To my great surprise eBay immediately closed the return in favour of the seller. Yet only 2 days previously a buyer had put in a return to me using reason 'doesn't fit' even though the item was correctly labelled; eBay had closed the return in the buyer's favour and I was happy to accept the return.
Now I am left very puzzled why I am left with a pair of shoes incorrectly described as to size and eBay have favoured the seller! I have tried to appeal against the decision but am just told the return has closed and nothing more to be done except 'contact the seller' to try and sort matters. It all seems very unfair.

Any number of buyers have! If you personalise it by saying an item "doesn't fit you" it's treated as a change of mind return.
You need to be factual, and show that an item is not the size stated. If it isn't, you can then open a money back guarantee case.
It's always risky to buy shoes unseen. Even if the shoe is the marked size, this is never a guarantee of a good fit. Variations in width in particular can make a huge difference. Not to mention differences between UK, US and Euro sizing.
If you buy shoes online, my advice would be to check that the seller accepts returns. If they do, eBay will enforce the return if they argue over it. Remember that UK business sellers are required to accept change of mind returns, but private sellers and sellers in other countries are not.
