Hi all I sold an item on ebay packed it shipped it by myhermes I paid extra to insure the item . As it was over the £50 .
So I get a message off the buyer the item has been damaged sent me photos of the item and the damaged box . Now I emailed myhermes and they said that I can claim for the amout it SOLD FOR NOT THE INSURED so I pay the buyer back and i get the busted item back to me which is no good how is that fair or even legal as i paid insurance on £190 . Covering the item price sold twice so I get half the buyer gets his half .
Which is what he paid for te item so as what it went for . Mind you I would have said the real value was more as the item is over 60years old .
So I'm out.of pocket and left with pile of junk no value at all now .

As regards the buyer, they claim under ebay's money back guarantee and you have to refund them the full cost, including delivery. Whether or not you can claim from Hermes is irrelevant to eBay.
What compensation you can claim from Hermes depends on their terms of service and what cover you paid for. There is no way you will ever get back more that the value of the item, whether based on the sale price, the orice you yourself paid for it or on Hermes's assessment of its value. This of course assumes that the item isn't excluded for compensation anyway, as many are - it's important to read the small print.
