Item out of stock but marked as dispatched

I recently bought an item that was not marked as being out of stock. I was then told the item had been dispatched, however I then got another message from the seller saying the item was not actually in stock. They asked if I could choose an alternative size item which I said I couldn't as this would not be of any use. They then asked if I would cancel the order but I cannot do this as the item has been marked as dispatched so there is no cancel option. They keep asking me to cancel and don't seem to understand that I can't do this through ebay. Any advice?

Ignore them. They sound hopeless. Just open an Item Not Received Case one day after the last estimated delivery date in the Resolution Centre.

 

Escalate the Case for Ebay to Step in after 4 days. They will fully Refund you. 

 

 

Find a better Seller with good Feedback.
