Help with a return going sour

Hi 

I bought a phone and it turned out to be faulty, so I sent I requested a return, the seller told me to contact the manufacturer (xiaomi) who in turn told me to return the phone to the seller. The seller requested my imei and I accidentally sent them the one from my old phone as I had gone back using it at the time and was having a busy day, they pointed this out so I quickly sent them the correct one, but unfortunately they had already decided I was doing something untoward and became suspicious of me. They did accept the return, which was originally for a replacement, but because of the time issues I had to buy a replacement and changed to asking for a refund. Now they have the phone they are trying to say there is nothing wrong with it and that I'm trying to scam them, insulting me for being "stupid" (because i sent the wrong imei) and threatening legal action against me.  I am not a scammer by any means, this entire ordeal has been expensive and inconvenient and I still don't understand what I would have stood to gain from this so called "scam". I really need to speak to a human being about this and get it sorted asap, its causing me a lot of stress.

Yes will be the 26th before you get the Option to "Ask Ebay to Step In"  It no longer seems to be 3 days. I recently opened an Item Not Received Case and had to wait 5 Days to Escalate it.

If you opened a "not as described" return case escalate it to ebay after 3 working days.  Go to the return case via the link on the ebay message, click on Case Details > Respond to Case > Escalate This Case > Submit.
