Fraud going unpunished...

Dear all, 

 

I am at my wits end with eBay. I am an eBay seller with 100% positive feedback and I use this site all the time to buy and sell. Hundreds of pounds a month often. So when eBay washes its hands of a buyer vs. seller dispute without even looking at the evidence I find it hard. What happened is as follows:

 

> I buy bulk lots of items to sell, not always from eBay but eBay is where i sell them.

>I find a bulk lot of new trainers in their boxes to sell, it has some pictures that show they are new and without marks and it has their sizes.

 

> I wait for these to arrive and then I check them for marks and scuffs, organise them on my shelves and list them for sale.

> I sell the first lot of trainers (at this point about 40days has passed which is important for eBay apparently) and dispatch them accordingly. 

> The buyer contacts me to say that the trainers are too small and not the size they say they are. 
> I apologise and issue a full refund immediately and check the rest of the stock with a measuring tape against size charts I find online and they are all too small. At a guess I would say the size 45s are infact 44s or 43 1/2s. 

> So how can I sell shoes that i do not know the exact size of that are also labelled incorrect sizes???

 

> So I contact the seller explaining the situation and asking for a refund and that I am happy to return the existing stock of fraudlent shoes. 

> The seller is furious saying that its my job to check it all before eBays 30 day time limit and I know thats the limit so I'll never see my money back. 

 

> So after a few messages of patiently trying to explain i receive an email from eBay saying that the case has been solved in the Sellers favour without even asking for my evidence. This is admittedly because I didn't go over the top on my inital email to the seller thinking I would be talking to someone reasonable (lesson learnt!!).

>I've subsequently called eBay who said on the phone they understand and agree, yes I can definitely leave negative feedback as people need to know and the they would make sure the sellers performance rating is altered. 

>Then I get put through to the appeals team. I say:

-1) either I am right and you (eBay) will never say you can sell whatever you like no matter how incorrectly labelled and providing the customer doesn't realise before 30 days you'll get away with it. 

-2) OR i can now sell the stock know its fraudlent and not issue refunds and you'll protect me in the same shameful way you have to the seller that I initially brought them from.

>Solid argument or so i thought. These people at eBay that I have used for years gave me the standard 'Computer says no.'  basically because it is passed 30 days. Well it needed that time to arrive and be sold and delivered to my buyer for anyone to know about the fraud. 

> They suggested that I take it up with PayPal as they sensibly have a 180days policy but the transaction was not done through PayPal so i can't.

 

 

To sum up, I am down £150. Nobody at eBay seems to care. I feel completely let down by a site i've used for nearly 10 years. Furthermore this scumbag seller is allowed to continue on doing what she does to whoever comes along next. Has anyone got any idea how to contact anyone with some compassion at eBay that doesn't involve being given the run around by the appeals team as I am lost?

 

If not once I have cleared my stock I will simply close my eBay account and not use this site again as being robbed is one thing, but pointing it out with the evidence and nobody even caring is something altogther more serious in my eyes.
