First Bid Wins!?

Wondering if anyone can help me with this please. I'm still on the eBay learning curve with a long way to go!

 

I've come across a seller that puts 'first bid wins' (or something similar) in the main title of every listing. I have checked their sold/completed items and this seems to be the case. The items are listed auction style with a 'starting bid' price and the 'make an offer' option. Buyers are doing either and the item is sold. I can understand the 'make an offer' option but don't get how the seller can do this for 1st actual bids. Should it not be BIN listings?

it would make more sense to list as a BIN

 

but the seller is within their rights to end the listing and sell to the first bidder,
