Didn't receive item, eBay moneyback guarantee expired, seller refusing to send item and has relisted

Bought an item back in May, completely forgot about it because had a lot of personal stuff going on. Seller recently reminded me the item was never sent, I asked for it to be sent and the person has ignored me since

 

I've sent multiple polite messages requesting for the item

 

Went on the seller's profile and saw tht they've actually relisted the item for sale!!!! Livid isn't even the word

 

I get that the moneyback guarantee has expired but surely there must be some sort of protection eBay can offer here. It's essentially stolen property now!

 

Any help or advice would be much appreciated

If you paid using Paypal they have a longer deadline so you can open a "not received" case here:

Escalate it after 2 days and before 20 days.

 

You have 180 days Buyer Protection with PayPal. If you Paid that way?  Log in and find Resolve a Problem down the left hand side and open a Case for Item Not Received. You

 

Escalate the Case after 2 days but before 20 days.
