I bought a watch which was listed as Excellent Condition but on arrival it had scratches on the face & around the bezel. I checked the listing again & noticed on closer inspection the scratches but hadn't noticed them on initial inspection before bidding as I thought they were due to the camera. I did check feedback & also noticed that she had great feedback so felt reassured with my bidding on the item & her description.
When I received the watch I did contact her & explained all this & did say as it was listed in Excellent Condition but was not I wished to return the item for a full refund. Her response was the pictures clearly showed the item & on that basis as I couldn't see the scratches it was in Excellent Condition. I disagree & feel that this is misrepresentation as she was clearly aware of the condition herself yet still stated it as being in Excellent Condition but it was not.
If the watch was described as being in excellent condition, it should have been in excellent condition.
If it had scratches on the face, these should have mentioned, as eBay requires. It isn't up to the buyer to spot barely visible scratches in the photo. In any case, it isn't in excellent condition if the face is scratched.

A case must be opened within 30 days after the actual or latest estimated delivery date. If the seller wants the item to be returned, eBay will enable them to send you a prepaid return label (this only applies if the item was located in the UK). After 8 days the option will appear to escalate the case, if necessary, for eBay to step in. If still unresolved escalate it, and don't agree to close the case before you have your refund.

When did you receive the item?
If the date today is still within 30 days of receiving the item, you can open an Item Not As Described case in the Resolution Centre.
Follow the instructions carefully and escalate to eBay on day 9 after opening the case if not refunded in the meantime.
eBay will force a full refund.
The seller should send you a prepaid tracked address label to use to send the item back for a full refund.
Add the tracking into the case details to prove you have sent the item back.
If it is too late for an eBay case you can open a similar case in PayPal.
You have 180 days to open a case there.
Escalate it after day 2 and before day 20 if not refunded in the meantime.
Perception is down to each individual person and if the pic shows scratches you don't really have a leg to stand on.
