Counterfeit items payment (used, auction)

So i won auction for some popular item. And there is a huge chance it might be a chineese replica (or might not). I asked seller to provide more info on his lot, pictures or other proof of authenticity (original listing has only 1 image of poor quality).  And the seller keeps ignoring my messages.

I`m willing to buy this lot if this is an original item. And i`m not going to pay 4x price for chineese ripoff i don`t need even for free.

And here is a deal. I want to pay for this lot, but i can`t because i`m not sure it will be exactly what i need and what is described.

But if i refuse to pay i will get some kind of strike or bad habbit badge.  And the seller will get away with it? Right?

SO. How i can force seller to proove his item is original or how i can legally refuse to pay this lot without getting strike from ebay.

the time to ask questions about an item is BEFORE you bid, not after you win,

the seller doesn't have to answer your questions and if you don't pay they can open a non payment case against you

if you pay and receive a fake you can open a not as described case in the Resolution Centre to get a full refund

You can't. What you can do is what you haven't even mentioned: use eBay's money back guarantee if the item you receive doesn't match the description.

EBay's MBG gives very strong protection, but be careful to check where the item is located AND where the seller is located. EBay's MBG still applies to items imported from abroad, but you're liable to have to pay for the return - not to mention the hassle of reclaiming any import duty paid.

To learn about eBay's money back guarantee, see: https://pages.ebay.co.uk/ebay-money-back-guarantee/

Better still, take a few minutes to read the full terms and conditions. It's so important to understand what's covered and what isn't, and the all-important time limits: http://pages.ebay.co.uk/help/policies/money-back-guarantee.html
