Cancelling a return request.

I received an item that wasn't as described in the listing. I won an auction for a vinyl album. In the listing it said that the album was in near mint condition. When I received it and played it there are several major scratches on side A which are very audible when played. I started a return request through the eBay system.

The seller has contacted me through eBay suggesting that I cancel the request and he will refund me the full amount paid plus I can keep the album as he doesn't want it back (not that I want to keep it).

My question is if I do as he requests and he doesn't reimburse me can I open a new return request for the same item to get a refund?

Seller should have the option to refund without return in the case,if you close the case before any refund there's a high chance you will receive nothing and wont be able to open another case with eBay.
